1. The service
Worksheets provides software for hospitality operations, including organisation and venue administration, staff workflows, timesheets, payroll exports, operational forms, document processing, cash reconciliation and reporting. Features may change as the service develops.
Worksheets is an operational record-keeping tool. It is not legal, tax, accounting, payroll or employment advice, and it does not replace an organisation's obligation to review records and comply with applicable laws, awards and workplace requirements.
2. Accounts and authority
You must provide accurate account information, protect your sign-in details and use an individual account. An organisation owner confirms that they have authority to create and administer the organisation and to invite people whose information will be handled through the service.
Organisation owners and managers are responsible for assigning appropriate roles and venue access, reviewing their user list and removing access when it is no longer required. A person invited by an organisation must follow that organisation's lawful workplace policies.
3. Trials, subscriptions and payment
New organisations may receive a seven-day trial without providing a payment card. Unless a paid subscription is activated, organisation access may be restricted when the trial ends.
Paid plans are billed at the price, frequency and currency shown at purchase. Plan limits may include staff, venues and OCR processing. Prices are shown exclusive of GST unless stated otherwise. Subscriptions may be cancelled for future billing, but amounts already paid are not automatically refundable.
Nothing in these terms excludes rights or remedies that cannot lawfully be excluded, including any applicable rights under the Australian Consumer Law. If a paid service fails to meet a non-excludable consumer guarantee, the remedies available under that law continue to apply.
4. Organisation data and workplace records
The organisation controls the workplace records entered by its users and decides who is authorised to access them. The organisation is responsible for having a lawful basis to collect, use and retain staff, location, payroll and operational information.
Organisations should verify OCR results, payroll exports, timesheets and calculated figures before relying on them. OCR and automated extraction can make mistakes, especially where source documents are unclear or unfamiliar.
Our handling of personal information is described in the Privacy Policy. Requests relating to employment decisions or the content of a workplace record may be referred to the relevant organisation.
5. Acceptable use
You must not misuse the service, attempt unauthorised access, interfere with security controls, upload unlawful or malicious material, impersonate another person, use another person's account, or use Worksheets in a way that infringes rights or breaks applicable law.
You must not use location, incident, payroll or staff information for an unlawful discriminatory, deceptive or harmful purpose. We may restrict access where reasonably necessary to protect users, data, the service or other organisations.
6. Third-party services
Worksheets relies on service providers for hosting, authentication, storage, OCR, email and payments. Their availability can affect parts of the service. Links or exports to third-party products do not make Worksheets responsible for those products or for how an organisation configures them.
7. Availability, changes and termination
We aim to provide a reliable service but do not promise uninterrupted or error-free access. Maintenance, security incidents, provider outages or events outside reasonable control may affect availability.
We may make reasonable changes to features, security controls and plan limits. Material changes that negatively affect a paid subscription will be communicated where reasonably practicable. An organisation may stop using the service and cancel its subscription. We may suspend or terminate access for serious misuse, non-payment, security risk or material breach of these terms.
8. Responsibility and liability
Each party remains responsible for loss caused by its own unlawful conduct, negligence or breach. To the maximum extent permitted by law, Worksheets is not responsible for indirect or consequential loss, loss caused by inaccurate information supplied by users, or decisions made without reviewing exported or automatically extracted records.
Where liability can lawfully be limited, our liability for a failure to provide services is limited, at our option, to supplying the affected services again or paying the reasonable cost of having them supplied again. This limitation does not apply where the law does not permit it.
9. General
These terms and the Privacy Policy form the agreement for use of the service. If part of these terms is unenforceable, the remaining terms continue. A delay in enforcing a right is not a waiver of that right.
These terms are governed by the laws of New South Wales, Australia, and the parties submit to courts with jurisdiction there, subject to any rights that cannot lawfully be limited.
